Stellungnahme Vernehmlassung Luftfahrtgesetz – Ausbau Gesichtserkennung im öffentlichen Raum geplant

Die in der Vernehmlassung geplanten Änderungen im Luftverkehrsgesetz [1] führen zu
1. Etablierung von Echtzeit-Gesichtserkennung im öffentlichen Raum
2. Einschränkung des Öffentlichkeitsprinzipes
Die Piratenpartei empfiehlt deshalb in ihrer Stellungnahme eine entschiedene Ablehnung dieser Vorhaben.

Echtzeit-Gesichtserkennung
Nur aus Bequemlichkeitsgründen sollen Privatunternehmen wie Flughafenbetreiber und Airlines biometrische Gesichtserkennung nutzen dürfen (Art. 107c). Eine Notwendigkeit dafür gibt es nicht. Da es sich bei biometrischen Gesichtsdaten um besonders schützenswerte Personendaten handelt, ist nicht nachvollziehbar, weshalb der Bund eine gesetzliche Grundlage für den Zugriff von Privatunternehmen auf diese schaffen will.
Weiter ist dies auch abzulehnen, da solche Daten ein besonders attraktives Ziel für Hacker darstellen. Schon allein, um sich eine E-ID ausstellen zu lassen, die der Bund plant. Die alltäglichen Leaks und Hacks sollten Warnung genug sein, sowohl diese besonders schützenswerten Daten nicht einem Hackingrisiko auszusetzen, als auch das Vertrauen in die geplante E-ID nicht zu erschüttern. Es wäre nur eine Frage der Zeit, bis massenhaft gefälschte E-IDs auftauchen.

Ebenfalls äusserst bedenklich ist, dass Menschen an Flughäfen immer mehr bereit sind, solche Eingriffe zu akzeptieren, um angebliche Sicherheit oder Komfort zu erhalten. Dieser Umstand, der als „Flughafeneffekt“ bezeichnet werden kann, zeigte sich bereits bei den „freiwilligen“ Nacktscannern oder den „freiwilligen“ Gesichtsscannern bei der Passkontrolle [3].
Dieses Nudging führt dazu, dass von einer echten Freiwilligkeit keine Rede sein kann. Stattdessen gewöhnen sich Menschen an die Nutzung von Gesichtserkennung im öffentlichen Raum – eine Entwicklung, die grundsätzlich abzulehnen ist.
Philippe Burger, Vizepräsident Piratenpartei: «Einige akzeptieren aus Bequemlichkeit Echtzeit-Gesichtserkennung, doch Studien zeigen, dass Fluggäste invasive Überwachungsmassnahmen an Flughäfen nur unfreiwillig tolerieren. Wir müssen uns als freiheitliche Informationsgesellschaft entschieden gegen die schleichende Gewöhnung an KI-gestützte, biometrische Massenüberwachung wehren.»

Einschränkung des Öffentlichkeitsprinzipes
Die geplante Einschränkung des Öffentlichkeitsprinzips im Luftfahrtgesetz (Art. 107d) ist entschieden abzulehnen, da sie Transparenz und Kontrolle staatlicher Behörden massiv beeinträchtigen würde. Berichte und Dokumente von zentraler Bedeutung, etwa zu Audits, Inspektionen oder Vorfällen, sollen künftig nicht mehr öffentlich zugänglich sein, sondern durch lückenhafte, gefilterte Informationen des Bundesamts für Zivilluftfahrt (BAZL) ersetzt werden. Dies untergräbt das Vertrauen der Bevölkerung in staatliche Institutionen, schwächt die wirksame Kontrolle der Behörden und behindert die demokratische Mitwirkung. Bereits bestehende Ausnahmen im Öffentlichkeitsgesetz bieten ausreichenden Schutz sensibler Informationen, während das Öffentlichkeitsprinzip essenziell für die Informationsfreiheit, die Medienfreiheit und die Modernisierung der Verwaltung bleibt. Die vorgeschlagene Regelung würde keinen dieser positiven Effekte erreichen und birgt das Risiko intransparenter Absprachen sowie eines Vertrauensverlusts in die Aufsichtsbehörden.

US should declassify what it knows about deadly Colombian Supreme Court attack

Colombian President Gustavo Petro is asking President Joe Biden to declassify U.S. records on one of Colombia’s most infamous human rights cases — its army’s 1985 siege of the Colombian Supreme Court.

Biden should agree to start the declassification process immediately. The U.S. has the unique ability to perform declassification diplomacy because of the quality of its archives, and it should engage in it regularly and proactively.

There is no danger in releasing these 40-year-old records, and they would help bring closure to families still searching for answers about what happened to their loved ones.

‘A volcanic disaster’

On Nov. 6, 1985, members of Colombia’s M-19 guerrilla group occupied the country’s Supreme Court building in Bogotá. (Petro was a member of M-19 at the time, but was detained before the assault.)

The CIA called M-19’s operation a “publicity-generating” stunt, but then-Colombian President Belisario Betancur was concerned that showing leniency would anger military leaders, and ordered a ferocious, disproportionate response.

The Colombian army launched a 27-hour siege of the building that killed 11 justices and over 100 civilians. Eleven people working in the building still remain unaccounted for, and are believed to have been tortured and killed by Colombian army intelligence for being collaborators. The CIA deemed the military’s handling of the event a “volcanic disaster.”

To date, accountability and answers about what happened to those disappeared by the military have proved scarce.

Colombia, whose records are not nearly as complete as those of the United States, has repeatedly asked for help finding answers. The Colombian truth commission wrote a letter to Biden in 2021 stating “Colombian archives are far from complete,” and “the extraordinary care taken by U.S. federal agencies to preserve and organize their own archives” would help the commission — and victims’ families — understand what happened.

Biden didn’t respond to that request.

He should make up for the oversight and help Petro now.

The president should direct the National Security Council to initiate a special declassification project immediately to ensure that the CIA, State Department, and Defense Intelligence Agency expeditiously release their records on the case.

FOIA requesters help fill the void

Some important U.S. documents on Colombia and the Palace of Justice have been declassified. This is largely thanks to the indefatigable efforts of researchers at the National Security Archive, a nonprofit organization based in Washington, D.C., where I served for years as public policy director. They’ve been filing FOIA requests on Colombia for decades.

The archive’s FOIA requests have won the release of information showing that the U.S. sent a six-person explosives team to Bogotá during the Palace of Justice crisis, considered sending the Colombians “12 asbestos suits” to help carry out their assault, and provided important political context for the military’s response.

These documents and their insights are important. And if you want to know more about declassified U.S. documents on Colombian civil unrest, there’s no better place to visit than the National Security Archive.

But the efforts by individual researchers can’t replicate the power of the president telling agencies to release their records, especially about what happened to the fate of the disappeared.

Countries turn to U.S. for records on human rights abuses

This isn’t the first time another country has asked the U.S. for help uncovering evidence of past atrocities.

The U.S. has already provided governments across Latin America with declassified records, and this kind of declassification diplomacy has demonstrable impacts.

In 1998, President Bill Clinton overrode objections from the CIA and ordered the declassification of U.S. records on human rights abuses committed by the Pinochet regime in Chile. The project successfully released more than 23,000 records from the State Department, CIA, FBI, and more, which were used in criminal trials in Santiago.

In 2002, the U.S. began supporting Peru's Truth and Reconciliation Commission by providing the Peruvian Congress with declassified documents. Some of these declassified records, which were also obtained by National Security Archive researchers in response to FOIA requests, were used to help successfully convict former Peruvian President Alberto Fujimori of human rights abuses.

Special declassification projects have also been carried out for records on El Salvador and Guatemala.

But the largest effort is the Argentina declassification project. It was initiated by President Barack Obama and completed by President Donald Trump, and successfully released over 47,000 pages of records from the CIA, FBI, State Department, National Security Council, and more on human rights atrocities committed by the Argentine military dictatorship.

Declassification diplomacy is one of the United States’ most distinctive foreign policy tools, and it must be deployed as often as possible.

Biden should follow in the footsteps of Presidents Clinton, Obama, and Trump, and promise to release what the U.S. knows about the Palace of Justice tragedy.

Stephen William Hawking (1942-2018)
est un physicien théoricien et cosmologiste britannique.

Après avoir obtenu son B.A. à Oxford en 1962, il est resté pour étudier l'astronomie. Il a quitté Oxford, avec les honneurs, pour Trinity Hall où il a participé à l'étude de l'astronomie théorique et la cosmologie théorique.
En 1965, il épouse Jane Wilde (1944), une étudiante en linguistique. Ils ont eu trois enfants: Robert (1967), Lucy (1969), et Timothy (1979). Le couple s'est séparé en 1990.

Presque dès son arrivée à Cambridge en 1965, il a commencé à développer les symptômes de la sclérose latérale amyotrophique (SLA, maladie de Charcot). Au cours de ses deux premières années à Cambridge, il ne s'est pas distingué, mais après la stabilisation de sa maladie et avec l'aide de son tuteur de doctorat, William Dennis Sciama, il est retourné travailler sur sa thèse de doctorat.
Après avoir obtenu son doctorat en 1966, Stephen est devenu chercheur à Gonville and Caius College (Cambridge). L'étude des singularités, concept physique et astronomique récent, permet au chercheur de développer différentes théories, qui le mèneront plus tard du Big Bang aux trous noirs. Tous ces travaux le conduiront à développer un modèle cosmologique fascinant en 1983, universellement connu aujourd'hui sous le nom de modèle de Hartle-Hawking.

Les travaux de Hawking ont été réalisés en dépit de l'aggravation de la paralysie causée par la SLA. Il a été professeur de mathématiques à l'Université de Cambridge de 1980 à 2009.

En 1995, Hawking s'est marié à son infirmière, Elaine Mason. En octobre 2006, il a demandé le divorce.

Stephen Hawking est connu pour ses contributions dans les domaines de la cosmologie et la gravité quantique, en particulier dans le cadre des trous noirs. Son succès est également lié à ses ouvrages de vulgarisation scientifique comme le best-seller "Une brève histoire du temps" (A Brief History of Time, 1988), qui est resté sur la liste des records des best-sellers du Sunday Times pendant 237 semaines consécutives et traduit en plus de 35 langues.

C'est un physicien théoricien de renommée mondiale dont la carrière scientifique s'étend sur plus de 40 ans. Ses livres et ses apparitions publiques ont fait de lui une célébrité universitaire.
En 2007, il écrit un livre, avec sa fille Lucy, "Georges et les Secrets de l'univers", premier tome de la série "Georges" qu'il écrira avec elle.

Leonard Mlodinow
est un un physicien, écrivain et scénariste américain.

Son père, qui a passé plus d'un an dans le camp de Buchenwald, était un des chefs de la résistance juive au nazisme en Pologne.

Pendant son doctorat à Berkeley et à Caltech, il développe (en collaboration avec Nikos Papanicolaou) un nouveau type de théorie de la perturbation pour les problèmes de valeur propre en mécanique quantique. Puis, soutenu par la Fondation Alexander von Humboldt à l'Institut Max Planck de Munich, il est un des pionniers de la diélectrique

En dehors de ses travaux de recherche fondamentale en physique et ses publications scientifiques, Mlodinow rédige des scénarios pour différentes séries télévisées comme Star Trek et MacGyver.

En 2005, il publie avec Stephen Hawking "Une belle histoire du temps" ("A Briefer History of Time"), une mise à jour de l'ouvrage de 1988 de Hawking "Une brève histoire du temps" ("A Brief History of Time").

Entre 2008 et 2010, Mlodinow travaille toujours avec Stephen Hawking sur le livre "Y a-t-il un grand architecte dans l'univers ?" ("The Grand Design", 2010)
